IPsotx Sàrl has created this privacy policy (the “Policy”) to explain our privacy practices so you will understand when and how personal information is collected, used, disclosed and protected with respect to our software(“Software”), and Web sites (“Site”) located at http://www.isotx.com and http://www.igmarauders.com. By using the Site and the Software, you consent to the privacy practices described in this Policy.

We reserve the right to change this Policy at any time. If we make any material changes to our Policy, we will post a new policy on our Site and update the “last revised” date set forth above and notify each registered user at the email address we have on file for them. The updated Policy will govern each use of the Site from the date of update forward. Therefore, we encourage you to check our Policy whenever you use the Site.

INFORMATION ABOUT YOU

We collect three basic types of information with our Site and Software, namely personal information, individual usage patterns and aggregate information. Personal information is information that is directly associated with a specific person or entity such as a user’s e-mail address, usage information and user-chosen ID and password. Individual Usage Patterns includes information automatically collected by the Software about your game play (including frequency and type of games played), and usage patterns of the Site, the Software and the third party software downloaded through the Software. We may share Individual Usage Patterns with third parties for various purposes, including to help us better understand and improve our services, and for advertising and marketing purposes.

Our definition of personal information does not include “aggregate information.” Aggregate information is data we collect about a group or category of services or users from which individual user identities have been removed. In other words, information on how you use our Site and Software may be collected and combined with information about how others use the Site and Software, but no personal information will be included in the resulting data. Aggregate data helps us understand trends in our users’ needs so that we can better consider new features or otherwise tailor our services. We may share aggregate information about our users with third parties for various purposes, including to help us better understand and improve our services, and for advertising and marketing purposes.

Those are the types of personal and other information we collect. You should refer to the rest of this Policy to see how we use, disclose and protect this information:

INFORMATION YOU GIVE US

We collect information you give us at various times when you register with us and use our Site and the Software. For example, when you register an account on the Site, we may collect various kinds of contact information about you including, for example, your e-mail address. You will also be asked to create a user-chosen ID and password for your use when accessing certain portions of the Site. We may also collect personal information if you provide it via e-mail, message boards, or other interactive services. Please do not post any information on the message boards or other interactive services that you expect to keep private. Also, we may collect information that identifies you personally when you send us comments, questions or suggestions.

AUTOMATICALLY COLLECTED INFORMATION

We automatically receive certain types of information whenever you interact with us. For example, when you use the Site, our systems may automatically collect your IP address and the type of browser or operating system you use. In addition, as you use the Software, we will collect certain information about your game play patterns, such as how long and what times you play, the level or attributes of your characters in the game. We use such information to show the software designers how individual users interact with their programs, as well as for advertising and promotional purposes.

We may also collect information pertaining to any transactions conducted by you on the Site, information pertaining to the files accessed or used by you, and standard access information, such as the time and date of accessing the Site, and usage of the Site. We use such information to help manage the effectiveness of our online advertising and to gather access information, such as counting the users who have visited those pages and compiling aggregated statistics about Site usage.

In addition, we use cookies to collect information so that we can improve our Site by seeing which areas and features are most popular; to personalize the Site and improve the Site experience; and to allow you to visit the Site without re-entering your member ID and/or password. We may use also cookies and similar tools to relate your use of the Site to personal information obtained from you or a third party. For example, if you’ve asked us to provide you with information about our products or promotions, cookie and/or click stream data about your activities on the Site may allow us to limit the materials we provide you to items we think you will find interesting, based on your prior online activities and preferences. We will not coordinate your personal information and web site activity information in this manner without first obtaining your express affirmative consent.

Most browsers automatically accept cookies as the default setting. You can modify the setting to reject cookies or to prompt you before accepting a cookie from the sites you visit by editing browser options. If you decide not to accept our cookies, you may not be able to use some of the Site’s features or services, and you may have a less satisfactory experience.

NO INFORMATION ABOUT CHILDREN

Our Site and Software is not intended to be used by children under the age of 13, and we do not knowingly, directly or passively, collect information from children under the age of 13. If we create offers and products that make it appropriate to collect information from children under the age of 13, we will notify you of the change in this Policy.

INTERNAL USE OF PERSONAL INFORMATION

All information collected is stored in our database and may be archived elsewhere.

Access to your personal information other than Individual Usage Patterns will be limited to ISOTX employees and contractors. In general, we use personal information internally to serve our users and enable them to take maximum advantage of our Site. We may also combine information about you that we have with information we obtain from business partners or other companies. For example, personal information may be used to conduct marketing analysis, to create an individual profile and provide personalized services, to provide services or complete transactions you have requested, to anticipate and resolve problems with our Software and Site, to respond to customer support inquiries, and to create and inform you of new products and services from ISOTX that better meet your needs. By registering with our Site, you give consent for us to communicate with you at any of the contact points you provide to us for any of the aforementioned purposes.

If a user elects to use our invite a friend feature via the ISOTX site we will automatically send this person an email. We will send an email to invite them to visit the site, download the client and add the user as a friend.

You should review the following section to understand when ISOTX discloses personal information to non-affiliated third parties.

DISCLOSURE OF PERSONAL INFORMATION OTHER THAN INDIVIDUAL USAGE PATTERNS

Except for Individual Usage Patterns (discussed below) We do not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you’ve requested, when we have your permission, or under the following circumstances: (i) as may be necessary to perform internal analyses and business functions; (ii) as part of a business transfer; or (iii) when required by law or permitted to protect our rights, property, or safety. The following section describes these disclosure circumstances more fully.

  • Consent. Unless you choose to do so, we will not disclose your personal information to third parties for their direct marketing purposes. With your consent, we may disclose your personal information to third parties so that they may provide you with products and services that you have requested.
  • Business Functions. We may share personal information with third-party vendors who assist us in performing internal functions necessary to operate our business. In the event that we use third-party vendors to assist us in performing these functions, the third parties may not use or disclose your personal information for any other purpose. For example, we may provide downloads of software for, or host play of, pre-release test, or “beta”, versions of games as well as partial game demonstrations, trials and full game downloads provided by the owner/publisher. In order to receive or participate in these programs, you may be required to provide personal information, which we may provide to the owner/publisher. Any personal information that you provide to game owners/publishers will be subject to the game owner’s/publisher’s privacy policy, and we have no control over the ways that game owners/publishers to whom you provide your personal information may use your personal information.
  • Targeted Advertising. We may display targeted advertisements based on personal information. Advertisers (including ad serving companies) may assume that people who interact with, view, or click targeted ads meet the targeting criteria—for example, women ages 18-24 from a particular geographic area. We do not provide any personal information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will assume that you meet the targeting criteria used to display the ad. Advertisers may include financial service providers (such as banks, insurance agents, stock brokers and mortgage lenders) and non-financial companies (such as stores, airlines, and software companies).
  • Internal Analysis. We may use information about you for our own internal purposes, such as to estimate our audience size, measure aggregate traffic patterns as well as to understand demographic, customer interest, and other trends among our users. We may outsource these tasks and disclose personal information about you to third parties in aggregate, provided the use and disclosure of your personal information by these third parties is restricted to performance of such tasks.
  • Business Transfers. Information about our users and the Site and Software is one of our most important business assets. Therefore, information about our users, including personal information, will be disclosed as part of any merger or acquisition, creation of a separate business to provide the Site or Software or fulfill products, sale or pledge of company assets as well as in the event of an insolvency, bankruptcy or receivership in which personal information would be transferred as one of the business assets of the company.
    • Protection of ISOTX and Others. We may release personal information in the good faith belief that release is appropriate and necessary to comply with legal process or authority (e.g., a lawful subpoena, warrant or court order); to enforce or apply our policies; to initiate, render, bill, and collect for amounts owed to us; to protect our rights, property, or personal safety of ISOTX, our users, our employees, or the public; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.

DISCLOSURE OF INDIVIDUAL USAGE PATTERNS

  • Consent. If you use the Software, it requires that you consent to our collection of your Individual Usage Patterns. We may use this information for internal and external marketing purposes as described below. We may also use the Individual Usage Patterns, along with your other Personal Information, in the manner described above.
  • Targeted Advertising. We may display targeted advertisements based on your Personal Usage Patterns, as well as market this information to third party companies. For instance, we may provide your game play statistics to the maker of a game you use via the Site or Software. That game maker may run a promotion offering a prize for each user of the Software who attains a certain level or achieves a certain task in the game. If the game maker wishes to notify you, it will do so through your ISOTX account.

THIRD-PARTY SITES

Please be aware that we may provide links to third-party Web sites as a service to our users. Some of these third party sites may be co-branded with an ISOTX or affiliated entity’s logo, even though they are not operated or maintained by ISOTX. The Site also carries advertisements from other companies. ISOTX is not responsible for the privacy practices of web sites operated by third parties that are linked to the Site or for the privacy practices of third party or national Internet advertising companies, which differ from ours. Specifically, our Forums section and Shopping section are run by third parties, and hosted on third party sites. Therefore, we encourage you to review and understand their policies and practices before providing them with information or visiting their sites.

NETWORK AND INFORMATION SECURITY

We use commercially reasonable efforts to protect your personal information, including safeguards such as firewalls, password-protected databases with limited physical or electronic access, and encryption. In addition, ISOTX may utilize secure technology such as SSL to transfer information provided by users, and additional measures in the processing of sensitive information. While we have taken efforts to guard your personal information, we cannot guarantee that your information may be not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others.

Your account information and access to certain portions of the Site is accessible only through the use of an individual user ID and password. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of our Site and Software by any person using your account user ID and password. Please advise us immediately if you believe your account user ID and password have been misused.

ACCESS AND CONTROL OF PERSONAL INFORMATION

If you are a registered user of our Site, you may view, correct, and delete your personal information through the Site. Generally, you should be careful when making any personal information available to the public.

We reserve the right to send you certain communications relating to our Software and Site, such as customer service responses and other administrative messages.

INTERNATIONAL USERS

By using our Site and providing us with data, you acknowledge and agree that due to the international dimension of ISOTX, we may use the data collected in the course of our relationship for the purposes identified in this policy or in our other communications with you, including the transmission of information outside your resident jurisdiction. Please note that your personal information will be stored and processed on our computers in the United States. The laws on holding personal data in the United States may be less stringent than the laws of your country. If you object to your personal information being transferred or used as described in this Policy, please do not register for the Site or use the Software.

UPDATING THIS POLICY

We may revise and update this Policy if our practices change, as technology changes, or as we add new services or change existing ones. Any changes will be posted to this document so that you will always know what information we gather and how we use it. If we make any material changes to our Policy or how we handle your personal information, we will post an updated Policy on our site and change the date of the Policy. If we are going to use any personal information in a manner that is materially different from that stated in our Policy at the time we collected such information, we will give you a reasonable opportunity to consent to the change. We will use information in accordance with the most current privacy policy.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. We do not provide your personal information other than Individual Usage Patterns to any third party for their direct marketing purposes without your consent.
